DUI

A drunk driving arrest does not automatically result in a conviction for a crime or the driver’s license suspension. Ted Kenney is a skilled DUI/DWI defense lawyer. Ted vigorously represents clients from all walks of life, and also advocates for many students at University of Vermont, St. Michaels College, and Champlain College who are charged with driving under the influence (a blood alcohol level of .08 or higher). Those cases are more complex in nature due to the zero tolerance law for underage drinking (a blood alcohol level of 0.02 or higher is illegal). These cases can also result in the student or young adult being charged with the crime of Possession of a Malt Beverage.

Ted has a thorough understanding of Vermont DUI/DWI law and knows that the police have many restrictions on when they can pull over or stop a car, ask a driver to engage in field sobriety testing, or take a breath test. Vermont’s Implied Consent Law is focused on preserving individual liberties and rights when it relates to the initial stop, video surveillance, and weaving.

Ted is skilled at recognizing facts that can show that a DUI/DWI stop violated your rights. He has successfully challenged the Data Master used for processing and the various field sobriety tests. His thorough knowledge of the Data Master has given him an advantage in challenging those chemists and an insight into the science involved in an alcohol charge. He often hires expert chemists to provide a detailed account of whether the Data Master was operating properly, and what a driver’s real blood alcohol content was at the time they were driving, not just the time they were tested at the police station.

Securing an acquittal or dismissal of charges is the objective, but Ted does not stop there. He fights to prevent law enforcement from violating your rights under the federal or state constitutions.
